1. The Nature of our website

1.1 Our website is a place for you to select and order Products described in the website.

1.2 Please note that our website is available only to individuals that can form legally binding contracts under English Law. You must be over 18 years to purchase the Products, using the payment method displayed on our website. If you do not qualify, click here to leave our website now.

2. Terms

2.1 Contract - means an agreement between us and you under English Law for the sale and purchase of Goods and Services incorporating these terms and conditions.

2.2 Goods - means and individual product described in our literature or website.

2.3 Services - means our service and support provided by us to you.

2.4 Order - means an an order made by you for our goods and services accepting these terms and conditions.

2.5 Acceptance of Order - means a written acceptance of your order once we have determined that the goods are in stock or can be produced with the timescale detailed in clause 3.3 below. Only when this is sent to you is a contract formed.

2.6 Services - means the service and support provided by us to you.

2.7 Normal Working Day - means 9am to 5pm on a working day.

2.8 Working day - means Monday to Friday, excluding Bank and other Public holidays.

3. Buying products on our website

3.1 To place an order you will need to click the button next to an individual product ‘Add to cart’ after you have specified the quantity you wish to order. You will then need to follow the procedures for payment as detailed in PayPal. Details of our prices for the Products are displayed on our website.

3.2 You must pay by credit or debit card at the time of order. The price of any Product is the price in force at the date and time of your order. We may change the price of any Product before you place an order. We try to ensure that our prices displayed on our website are accurate but the price on your order will need to be validated by us as part of the acceptance procedure. We will inform you if a Product’s correct price is higher than that stated in your order and you may cancel the order and decide whether or not to order the product at the correct price. The prices are exclusive of delivery costs.

3.3 The Farm Workshop is entitled to refuse any order placed by you. If your order is accepted, we will confirm acceptance to you by online electronic means (‘Confirmation’) to the email address you have given us on ordering. The order will then be fulfilled  within 20 working days. To avoid disappointment at peak times of year, e.g. Christmas order in plenty of time.

3.4 You undertake that all details you provide to us for the purpose of purchasing goods or services which may be offered by us on our website will be correct, that the credit or debit card, which you use is your own and that there are sufficient funds or credit facilities to cover the cost of any goods or services. We reserve the right to obtain validation of your credit or debit card details before providing you with any goods or services.

3. Delivery

3.1 Delivery in the UK will be made as soon as possible as most items are in stock but no later than 10 working days from the date we receive the order. If we cannot deliver with 10 working days we will notify you by email at which time you can accept the later date or cancel your order and receive a full refund.

3.2 Delivery within the UK will be by MyHermes at a cost of £5.00. It is your responsibility to ensure that someone is available to sign for the Goods or make other arrangements with MyHerrmes to receive the Goods. An electronic notification will be sent at the time of despatch.

3.3 Delivery outside the UK will be by agreement.

4. Non-delivery

Claims for ‘non-delivery’ are to be made within ten (10) working days of the electronic notification of despatch. Please Contact Us by email and an investigation will be carried out with the MyHermes and a reply obtained before replacement Goods will be dispatched. We apologise for any delay this may cause. Refunds will not be made.

5. Damage in transit

Claims for ‘Damage in Transit’ are to be made within five (5) working days of the electronic notification of despatch. Please Contact Us by email with photos of the damaged parcel and its contents and an investigation will be carried out with Royal Mail. In the meantime we will send replacement figures.

6. Quality and manufacturing faults

The quality of the images is as shown on the website, however the colours may vary from that shown due to the vagaries of the photographic process and your screen resolution. All goods are examined closely before despatch and may contain defects in the wood used. These are natural faults in reclaimed wood and are part of the ‘rustic’ style of our environment friendly figures.

Sometimes cracks or splits will appear as the wood dries out due to modern heating systems. You may feel this adds to their ‘rustic’ charm and leave it or fill the crack with household filler, such as Polyfiller, wait till it dries, sand and paint with a white emulsion. Emulsion paint can also be used to freshen the figures in years to come.

However, if Goods are received that do contain manufacturing faults, e.g. missing paint, Contact Us by email within five (5) working days of the electronic notification of despatch with a photo of the faulty Goods. If the complaint is accepted we will send replacement figures. Refunds will not be made. If when we examine the goods, it is evident that the defect has arisen through misuse on your behalf, or you have altered the Goods, then we reserve the right to refuse or limit any replacement.

We also reserve the right to change the design of our figures without notice and they may not be as shown on the website.

7. Returns

You may return any Products you have purchased within 5 working days of delivery for any reason (including if you simply change your mind). To do so just return the goods within those 5 working days with the reason for the return. On receipt by us of the goods in good condition you will be entitled to a refund, excluding delivery, from the Farm Workshop, which will be paid as soon as possible, but in any event within 30 working days from receipt of the goods by us in good condition. You must arrange for and pay the costs of returning the Products to The Farm Workshop. While in your possession, you must keep any Products you intend to return to us in good condition.

8. Site security

We are extremely sensitive to the fact that there is general concern about Internet Security and so we treat this subject with the highest priority.

8.1. Entering Personal Information

When you enter your personal information, name address etc. either at the checkout or in any correspondence with us we will treat it in confidence and it will not passed to any third party. 

8.2. Entering Credit Card Details

We do not handle or store credit card details on our website. When you complete checkout, you are transferred to WorldPay for payment processing, before being transferred back to our site for final order confirmation. WorldPay is a highly secure site.

8.3. Secure Page

You will know when you are viewing a secure page - the address will start with 'https://' (note the 's').

Recommendation

We highly recommend that anyone using the Internet should install a security suite such as Norton Internet Security or Kaspersky Internet Security.

8.4. Privacy Policy

We have created this privacy statement in order to demonstrate our firm commitment to privacy. The following article describes what information we gather from you and how we use it.

8.5. Cookies

WorldPay’s system may use cookies to enable them to track information such as what items were added to your shopping cart, while you are logged into a customer account etc. These are known as 'session cookies' and are placed on your computer by their server. That is why you are able to add items to your shopping cart today, shut down your computer, revisit our site the following day and the items are still in your shopping cart. The only cookie we use tells us that you visited the site and whether you return, not who you are.

8.6. Personal Information

When you place an order with us or register for a customer account, we record your name, address, telephone number and email address. We may use this information to contact you with regards to an order you have placed or a query you have raised with us. We will also use your email address to send promotional emails from time to time; if you no longer wish to receive emails, please follow the instructions at the bottom of the emails and I will remove your details from my mailing list.

8.7 Further use of Information

Other than for the reasons stated above, we will not use your information in any way whatsoever and will not divulge your information to anyone outside of our business.
